Welcome to www.TyreCapital.co.za, an online store offering tyre consumables, including patches and gaiters, operated in South Africa. By accessing or using www.TyreCapital.co.za, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use the Site.

1. Acceptance of Terms

These Terms govern your use of the Site, including purchases, returns, and interactions. We may update these Terms at any time, and continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old or have legal parental consent to use this Site. By using it, you represent that you meet this requirement and are legally capable of entering into a binding agreement.

3. Products and Pricing

All products are described on the Site as accurately as possible. We reserve the right to correct errors, adjust prices, or discontinue items without notice.
Prices are in South African Rand (ZAR) and include VAT where applicable, unless otherwise stated. Shipping costs are additional and detailed at checkout.
Product availability is subject to stock levels, and we are not liable for delays or unavailability.

4. Orders and Payment

Orders are subject to acceptance and confirmation. We reserve the right to refuse or cancel orders at our discretion.
Payment is processed via third-party gateways listed on the Site. You agree to provide accurate payment information and authorize charges.
Ownership of products transfers to you upon full payment and delivery.

5. Returns and Refunds

Returns are accepted within 7 days of delivery for unopened, unused products, as per our Return Policy. Shipping costs for returns are the customer’s responsibility.
Defective items may be returned within 7 days with proof, and we will cover replacement shipping. See our Return Policy.
Refunds are processed within 10 business days after inspection, minus shipping fees.

6. Intellectual Property

All content on the Site, including text, images, and logos, is owned by www.TyreCapital.co.za or its licensors and protected by South African and international copyright laws. You may not reproduce, distribute, or modify this content without our written consent.

7. User Conduct

You agree not to:

  • Use the Site for illegal purposes or to transmit harmful content (e.g., viruses).
  • Attempt to interfere with the Site’s operation or security.

8. Limitation of Liability

www.TyreCapital.co.za is not liable for indirect, incidental, or consequential damages arising from Site use, product defects (beyond defective goods provisions), or delays, to the extent permitted by the Consumer Protection Act. Our total liability shall not exceed the purchase price of the product.

Your personal information is handled per our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA). By using the Site, you consent to data collection and use as described therein.

10. Termination

We may suspend or terminate your access to the Site for breach of these Terms, with or without notice. Upon termination, your right to use the Site ceases immediately.

11. Governing Law

These Terms are governed by the laws of South Africa. Any disputes will be resolved in the courts of Pretoria, subject to the CPA and ECTA.
